The organiser of the raffle is New Horizon GmbH, Neue Schönhauser Straße 2, 10178 Berlin, hereinafter referred to as the “Organiser”.
2.1 As part of the “Timeless Easter Hunt Campaign 2025”, three Timeless portfolios will be raffled. These portfolios consist of fractional ownership interests in assets selected at the sole discretion of the organiser. These assets included are part of the so-called “Timeless Easter Collection” and are clearly marked with an Easter egg symbol in the Timeless app and on https://www.timeless.investments/ in the “Drops” section.
A Timeless Portfolio of the following value will be raffled off among the eligible users (see section 3.1.)
The winners will be determined by a random draw among all eligible users who fulfil the requirements for participation in the competition as defined in point 3.
2.2 Should the prize not be available due to circumstances beyond the control of the Organiser, the Organiser reserves the right to replace the prize with one of equal value.
3.1 Only persons who are at least 18 years old at the time of registration for the raffle, who purchase a fractional ownership share in a Drop asset at least 4 times during the promotion period until the end of the prize draw and who are resident in the European Union, Switzerland or the United Kingdom (hereinafter: eligible users) are entitled to participate.
3.2 Legal representatives and employees of the Organiser, dealers and sales partners as well as all persons involved in the implementation of the raffle and family members of the aforementioned persons are excluded from participation.
3.3 The raffle begins on 02.04.2025 (18:00:00) and ends on 30.04.2025 (23:59:59). Late entries, regardless of the reason, cannot be considered.
3.4 Participants take part in the raffle by purchasing four (4) fractional ownership shares in drop assets that form a part of the “Timeless Easter Collection” within the promotion period in accordance with section 3.3 and agreeing to these conditions of participation.
3.5 Participation in the raffle is only possible once per eligible user. The chances of winning can be increased by purchasing a further fractional ownership share in other drop assets that are labelled as part of the “Timeless Easter Collection”.
3.6 Participation in the raffle and claiming the prize is free of charge for participants.
4.1 The Organiser will randomly select three winners from the eligible users who meet the requirements in section 3. One Timeless portfolio worth approximately EUR 750.00, one Timeless portfolio worth approximately EUR 500.00 and one Timeless portfolio worth EUR 250.00 will be raffled off among all eligible users. The winners are responsible for paying tax on their winnings.
4.2 The winners will be contacted by e-mail shortly after the end of the raffle and asked to confirm acceptance of the prize within a period of one (1) week.
4.3 After confirmation of the win, the portfolio will be credited to the respective winner’s wallet in accordance with section 4.1.
4.4 If one of the winners does not confirm acceptance of the prize within a period of one (1) week, the prize will be forfeited. If the contact details provided are incorrect (e.g. invalid email address), the Organiser is not obliged to find the correct email address. Any disadvantages resulting from the provision of incorrect contact details shall be borne by the participants. If the prize cannot be correctly allocated in the course of the raffle due to incorrect data, the participant’s claim to the prize shall lapse.
4.5 Cash payment of the prize is not possible.
4.6 If the prize is forfeited as a result of a participant not accepting it in good time or if a participant renounces the prize, the prize will be drawn again.
4.7 It is not possible to exchange and/or transfer any winnings or any difference.
5.1 The Organiser reserves the right to exclude participants from the raffle who violate the conditions of participation or applicable law, attempt to influence the raffle through technical manipulation or infringe the rights of third parties.
5.2 In the event of exclusion from the raffle, prizes can also be subsequently cancelled and reclaimed.
6.1 It should be noted that the availability and function of the raffle cannot be guaranteed. Due to external circumstances or constraints, the raffle may be terminated in whole or in part or its course altered without notice, without this giving rise to any claims by participants against the Organiser.
6.2 This may include technical reasons (e.g. computer virus, manipulation or errors in software or hardware) or legal reasons (e.g. rule changes or decisions by Facebook/Instagram) that may affect the proper execution of the raffle.
7.1 The liability of the Organiser shall be governed by the statutory provisions, unless otherwise stipulated in this agreement. The Organiser shall be liable for damages, irrespective of the legal grounds, in the event of intent and gross negligence. In the event of simple negligence, the Organiser shall only be liable for damages resulting from injury to life, limb or health and in the event of a breach of a material contractual obligation (an obligation whose fulfilment is essential for the proper execution of the raffle and on whose compliance the contractual partner regularly relies and may rely); in the latter case, however, the liability of the Organiser shall be limited to compensation for foreseeable, typically occurring damages.
7.2 Insofar as the liability of the Organiser is excluded or limited in this agreement, this also applies to the personal liability for damages of the employees, workers, staff, representatives and vicarious agents of the Organiser.
8.1 Should a provision of the terms and conditions be or become invalid, this shall not affect the validity of the remainder of the contract. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic sense and purpose of the invalid provision in a legally permissible manner.
8.2 The law of the Federal Republic of Germany shall apply to the exclusion of the conflict of laws provisions.
