The Organiser of the raffle is New Horizon GmbH, Neue Schönhauser Straße 2, 10178 Berlin, hereinafter referred to as the “Raffle Organiser.”
2.1 A portfolio with an equivalent value of approx. EUR 500.00 consisting of assets selected by the Organiser will be raffled off. A total of three portfolios, each worth approximately EUR 500.00, will be raffled off among the eligible users (see section 3.1).
2.2 If the prize cannot be made available for reasons for which the competition Organiser is not responsible, the competition Organiser reserves the right to provide a replacement of equal value.
3.1 Participation is restricted to individuals who are at least 18 years old and, at the time of registering for the raffle during the campaign period and up until the end of the raffle, acquire at least one fractional ownership interest in a drop asset and reside in the European Union, Switzerland, or the United Kingdom (hereinafter: eligible users).
3.2 Excluded from participation are legal representatives and employees of the Raffle Organiser, retailers, and distribution partners, as well as all persons involved in the execution of the raffle and their family members.
3.3 The raffle begins on 15 November 2024 at 12:00:00 p.m. and ends on 16 November 2024 at 11:59:59 a.m. Late entries, regardless of the reason, cannot be considered.
3.4 Participants enter the raffle by acquiring a fractional ownership interest within the campaign period in accordance with Section 3.3 and agreeing to these terms and conditions
3.5 Participation in the raffle is limited to one entry per eligible user or eligible shareholder. Purchasing multiple fractional ownership interests does not increase the chances of winning.
3.6 Participation in the raffle and claiming the prize involves no costs for the participants.
4.1 The Raffle Organiser will select three winners from among the eligible users using a random number generator, provided they meet the conditions outlined in Section 3. Among all eligible participants, three Timeless Portfolios, each valued at approximately EUR 500.00, will be raffled. The winners are solely responsible for the taxation of their prizes.
4.2 Winners will be contacted via email shortly after the raffle ends and will be asked to confirm acceptance of their prize within one (1) week.
4.3 Upon confirmation, the respective winner’s portfolio, as described in Section 4.1, will be credited to their wallet.
4.4 If a winner does not confirm acceptance of the prize within one (1) week, the prize will be forfeited. If the contact information provided is incorrect (e.g., invalid email address), the Raffle Organiser is not obliged to investigate further. Any disadvantages arising from incorrect contact data are borne by the participants. If the prize cannot be correctly allocated due to incorrect data, the participant’s claim to the prize lapses. If a winner cannot prove ownership of the NFTs or shareholding, a new winner will be selected.
4.5 Cash payment of the prize is not possible.
4.6 Should the prize lapse due to untimely acceptance or should a participant decline the prize, it will be raffled again.
4.7 The exchange and/or assignment of a prize or any potential difference in value is not possible.
5.1 The Raffle Organiser reserves the right to exclude participants who violate the participation terms or applicable law, attempt to manipulate the raffle through technical means, or infringe upon the rights of third parties.
5.2 In the event of exclusion, any prizes may also be revoked or reclaimed retroactively.
6.1 It is noted that the availability and functionality of the raffle cannot be guaranteed. The raffle may be terminated or changed, wholly or in part, without notice due to external circumstances or constraints, without giving rise to claims by participants against the Raffle Organiser.
6.2 Such reasons may include technical issues (e.g., computer viruses, manipulation, or software/hardware malfunctions) or legal reasons (e.g., changes in regulations or decisions by Facebook/Instagram) that impair the proper execution of the raffle.
7.1 The liability of the Raffle Organiser is determined by statutory provisions unless otherwise specified in this agreement. The Raffle Organiser is liable for damages, regardless of the legal basis, in cases of intent and gross negligence. In cases of simple negligence, the Raffle Organiser is liable only for damages resulting from injury to life, body, or health, as well as for breaches of material contractual obligations (obligations whose fulfilment is essential to the proper conduct of the raffle and on whose compliance the contractual partner regularly relies and is entitled to rely); in the latter case, the liability of the Raffle Organiser is limited to compensation for foreseeable, typically occurring damages.
7.2 Where the liability of the Raffle Organiser is excluded or limited in this agreement, this also applies to the personal liability of employees, staff, representatives, and agents of the Raffle Organiser.
8.1 Should any provision of these terms be invalid or become ineffective, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a legally permissible provision that most closely approximates the economic sense and purpose of the invalid provision.
8.2 The law of the Federal Republic of Germany shall apply, to the exclusion of conflict of laws provisions.
